Last updated: 18 October 2026
1. Introduction
These terms and conditions ("Terms") govern your access to and use of the 1 Stop Motors Limited ("1 Stop Motors", "we", "us", "our") website at 1stopmotors.co.nz and the services we provide, including the sale of motor vehicles and the arranging of finance through third-party finance providers.
By accessing our website, submitting an enquiry, submitting a finance application, or purchasing a vehicle from us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services. Please read these Terms together with our Privacy Policy, which forms part of these Terms.
Address suggestions are provided by Google Maps. Use of those suggestions is also subject to the Google Maps Additional Terms of Service and Google Privacy Policy.
2. About us
1 Stop Motors is a registered motor vehicle trader based in Auckland, New Zealand. We sell motor vehicles and we help customers arrange finance by submitting finance applications to third-party finance providers. If your finance proceeds, the details are set out in the credit contract that applies to your loan.
You can contact us at any time:
- Email: sales@1stopmotors.co.nz
- Phone: 0800 22 00 18
- Address: 42 Queen Street, Otahuhu, Auckland 1062
3. Eligibility
To purchase a vehicle or apply for finance through us, you must be at least 18 years old, a New Zealand resident or citizen, and able to enter into a legally binding contract. Additional eligibility criteria apply to finance and are set by each finance provider.
4. Use of our website
You may use our website for lawful purposes only. You agree not to use our website in any way that breaches any applicable law, infringes the rights of others, or interferes with the operation or security of the website. The content of our website, including text, images, logos and branding, is owned by or licensed to 1 Stop Motors and is protected by intellectual property laws. You may not copy, reproduce or distribute our content without our permission.
Our website may contain links to third-party websites, including the websites of finance providers. We provide those links for your convenience. We do not control and are not responsible for the content, products or services of any third-party website, and a link does not mean we endorse that website.
5. Vehicle listings, descriptions and pricing
We take care to describe our vehicles accurately. Vehicle descriptions, specifications, features, photographs and odometer readings are provided in good faith and are intended as a general guide. Photographs may be illustrative and may not show the exact vehicle, options or condition. We recommend you inspect a vehicle, or arrange an inspection, before you commit to purchase.
Vehicles are offered subject to availability and may be sold, withdrawn or have their price changed at any time before you enter into a sale agreement. Advertised prices may exclude on-road costs unless stated otherwise. Where on-road costs or other charges apply, they will be itemised and disclosed to you before you complete your purchase.
Nothing in this section limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
6. Vehicle purchase process
A deposit may be required to secure a vehicle. Any deposit terms, including whether and when a deposit is refundable, will be made clear to you at the time. Ownership of a vehicle passes to you in accordance with your sale agreement and applicable law, generally once full payment has been received and cleared, or once finance has settled.
Where your purchase is funded by finance, settlement of your purchase is conditional on the finance provider approving and settling your finance. If finance is declined, any sale that is conditional on finance may not proceed, and any deposit will be dealt with in accordance with your sale agreement and your rights under consumer law.
Please note there is no general cooling-off period for vehicle purchases in New Zealand. Once you enter into a sale agreement you are committed to it, subject to your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, and subject to any term that makes your purchase conditional on finance.
7. Trade-ins
If you trade in a vehicle as part of your purchase, you confirm that you are the legal owner of that vehicle (or are authorised to sell it), that it is free of any money owing or security interest unless you have told us otherwise, and that the information you give us about it is true and complete. Any money owing on a trade-in vehicle may be deducted from the trade-in value or settled as part of the transaction.
8. Consumer Guarantees Act 1993
Where it applies, our vehicles and services come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993. Nothing in these Terms limits or excludes your rights under that Act. Any voluntary dealer or mechanical warranty we offer is in addition to, and does not replace, your rights under the Consumer Guarantees Act 1993.
9. Fair Trading Act 1986
We are committed to fair and accurate representations about our vehicles, finance and services, consistent with the Fair Trading Act 1986. If you believe any information we have provided is unclear or inaccurate, please contact us so we can address it.
10. Finance applications
Mobile number verification
When you select Confirm in the finance application, we may send an SMS confirmation code to the mobile number you provide. We use the code to verify that you can access that number and to let you continue your application. These messages relate only to your application. Submitting an application does not opt you in to marketing texts.
1 Stop Motors helps you arrange finance. We may submit your finance application to one or more third-party finance providers, and we act as an agent for finance providers in arranging and administering finance.
Submitting a finance application does not guarantee approval of finance. Whether your application is approved, and on what terms, is subject to the finance provider's assessment and lending criteria. Finance terms, interest rates, fees and conditions are determined by the finance provider and are set out in the credit contract that applies to your loan.
By submitting a finance application, you confirm that the information you provide is true, accurate and complete, and you understand that providing false or misleading information may affect your application or your credit contract.
Finance is subject to lender approval, credit checks, affordability and suitability assessment. Responsible lending criteria, fees and terms apply. Approval is not guaranteed.
11. How we are paid
1 Stop Motors receives a commission or payment from finance providers when finance is arranged through us. The amount we receive can vary depending on the finance provider and the finance arranged.
In some cases an introduction or arrangement fee may apply in connection with arranging your finance, and where it applies it may be included in your finance contract. Any such fee, together with the interest, fees and charges set by your finance provider, will be disclosed to you in your credit contract before you enter into it. The finance provider, not 1 Stop Motors, sets the interest rate, fees and charges that apply to your loan. The commission we receive does not change your right to choose your finance provider.
12. Responsible lending
The finance providers we deal with are subject to the responsible lending obligations in the Credit Contracts and Consumer Finance Act 2003 (CCCFA), including assessing whether credit is suitable for your needs and whether you can afford the repayments without suffering substantial hardship. The lending decision is made under the finance provider's responsible lending process. As part of preparing and submitting your application, we may ask you for information about your income, expenses and circumstances so that this assessment can be carried out.
13. Credit checks and credit reporting
By submitting a finance application, you authorise us and the finance providers we deal with to make inquiries with credit reporting agencies about you. These inquiries may be recorded on your credit file and may be visible to other credit providers. Repayment history and any default information may be reported to credit reporting agencies, consistent with the Credit Reporting Privacy Code 2004 (as amended).
14. Personal information and privacy
We collect, use and disclose personal information in order to provide our services, including preparing and submitting finance applications, arranging your vehicle purchase, and meeting our legal obligations. We may disclose your personal information to finance providers, lenders, insurers, credit reporting agencies, debt collection agencies, our service providers and government bodies, as reasonably necessary.
How we handle personal information is set out in full in our Privacy Policy, which forms part of these Terms. We handle personal information in accordance with the Privacy Act 2020.
Our use of Google Analytics and Meta Pixel, the information involved and your privacy choices are explained in section 11 of our Privacy Policy. Accepting these Terms or submitting an enquiry or finance application does not give consent to optional tracking. Any permission required for optional tracking, or informed authorisation needed for an overseas disclosure, is requested separately.
15. Financial hardship
If you experience financial difficulty or unforeseen hardship in meeting your repayments, you may be entitled, depending on your circumstances and the timing, to apply to your finance provider for a hardship variation under the CCCFA. Because we are not the lender, hardship applications are dealt with by your finance provider. You are welcome to contact us and we will help direct you to your finance provider's hardship process. Acting early, before you fall behind, generally gives you the best options.
16. Default and repossession
Default, enforcement and any repossession of a financed vehicle are governed by your credit contract and by Part 3A of the CCCFA. If you have concerns about default or repossession, please contact us or your finance provider, and we will help you understand the process and who to speak to.
17. Insurance and optional add-on products
You may be offered optional products in connection with your vehicle or finance, such as insurance or a mechanical warranty. These products are optional. Where an optional product has a cost, and where that cost is financed, it may increase the total amount you pay. The terms of any optional product, including any cost, will be disclosed to you before you agree to it, and any insurance product is subject to the insurer's own terms.
18. Agent and financial service provider status
1 Stop Motors arranges finance as an agent of third-party finance providers, under those providers' financial service provider registrations and licensing. Each provider's registration on the Financial Service Providers Register, its dispute resolution scheme, and its hardship process are available on that provider's website. We can help direct you to the right provider if you are not sure who holds your finance.
19. Identity verification
We may be required to verify your identity and collect supporting documents to meet our legal obligations, including obligations relating to anti-money-laundering and motor vehicle trading. We may decline to proceed with a transaction if we are unable to verify your identity.
20. Disputes and complaints
We want to resolve any concern quickly and fairly. Please contact us first at sales@1stopmotors.co.nz or 0800 22 00 18 so we have the chance to put things right.
Vehicle or service complaints. If we cannot resolve a complaint about a vehicle or our service, you may refer the matter to the Motor Vehicle Disputes Tribunal.
Finance or credit complaints. Because we arrange finance through third-party providers, an unresolved complaint about your finance or credit can be referred to the relevant finance provider's approved dispute resolution scheme. Each provider belongs to an approved financial dispute resolution scheme, and the scheme name and contact details are available on that provider's website. We can help you find the right scheme for your finance.
21. Limitation of liability
To the maximum extent permitted by law, 1 Stop Motors is not liable for any indirect, incidental or consequential loss arising out of or in connection with your use of our website or services. Our total liability to you, to the extent it can lawfully be limited, is limited to the amount you have paid us, if any, for the relevant service. Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other consumer law that cannot be excluded.
22. Indemnity
You agree to indemnify 1 Stop Motors against any loss or cost we reasonably incur as a result of your breach of these Terms or your provision of false or misleading information, except to the extent that loss or cost is caused by us.
23. Amendments
We may update these Terms from time to time. The current version is always available on our website, with the last-updated date shown at the top. Changes apply from the date they are published. Your continued use of our website or services after a change means you accept the updated Terms.
24. General
If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms continue to apply. Our failure to enforce any right does not waive that right. You may not transfer your rights or obligations under these Terms without our consent. These Terms, together with our Privacy Policy and any sale or finance documents you sign, form the entire agreement between you and us in relation to their subject matter.
25. Governing law
These Terms are governed by New Zealand law, and you submit to the non-exclusive jurisdiction of the New Zealand courts.
